Kaduna State Board of Internal Revenue (BIR) yesterday dragged the management of Ahmadu Bello University (ABU), Zaria, and Kaduna Polytechnic before a Tax Appeal Tribunal sitting in Kaduna over the non-payment of tax liabilities accrued to the sum of N6.169,774,658.01 billion and N3.436,864,461.06 billion respectively by the institutions.The matter which was brought before the tribunal via a notice of appeal filed by the counsel to the appellant, S.A Maisamari, dated January 16, 2014, sought an order of the tribunal to compel the two respondents to pay the outstanding tax liabilities.
The notice also gave the grounds of appeal to include that the respondents had failed to comply with the demand notice served the two appellants, dated November 15, 2013.
The matter was mentioned at the North-West zonal office of the tribunal yesterday before its chairman, Bashir Abdullahi, and four other members.
Lawyers to the appellant, led by I.M. Samson, an Assistant Director in the state Ministry of Justice, presented a motion on notice, seeking an order of extension of time for them to file their motion out of time, and the second, deeming the originating process in the suit as duly filed and signed.
Counsel to respondents, M.A Garba and Nathan Dandien for ABU and Kaduna Polytechnic respectively, did not oppose the motion on notice.
The case was however adjourned to September 10, 2014 for further hearing.
